Terms of Service
I. General Terms
Both artist and client must remain kind, courteous, and communicative throughout the commission process. If conflicts arise, both parties reserve the right to cancel the commission.
The client must provide at least one accurate visual reference for me to work with. Providing supplemental information or further visual references will allow me to illustrate a character more effectively. The presence of shading on reference images may also lessen my ability to accurately portray a character, so I prefer flat-colored references. Shading on pose references, however, does not make a difference.
I will NOT draw NSFW or hateful content. These terms are non-negotiable, and attempts to convince me otherwise may warrant being blacklisted from my commissions altogether.
You must be AT LEAST over the age of 13 to commission me. This is primarily due to the policies of the platforms that I use to conduct my business. I will not ask for legal documents regarding my clients’ ages, but if I suspect that a client is under 13 years of age, it is within my right to cancel their commission(s) and refuse to work with them thereafter.
No physical goods will be sent to the client once the commission has been completed. These commissions are solely digital, and will be sent to the client as a .png file via Discord or another digital messaging service. The client may also request the file as a .psd if the commission is unfinished and falls under the exceptions listed in section V, rule 1.
If you do not wish for me to post your finished commission online, you must inform me BEFORE the commission process begins. This also applies if you only want me to post it on some platforms, or if you do not want me to post it at all until a certain date passes (such as for a birthday or anniversary gift).
My ToS may be subject to change at any time. Changes will not be applied retroactively, and will only affect clients who order a commission after the date that the changes are implemented.
II. USAGE POLICY & COPYRIGHT
I, the artist, will always retain the rights to the original artwork. This means that I will always reserve the right to claim it as my own, use it as an example for future commissions, and share it online to promote my work.
Clients are permitted to use commissioned artwork for noncommercial purposes as long as I, the artist, am directly credited for the work. Examples of permitted use are as profile pictures, reference images, profile banners, etc.
Clients are NOT permitted to use commissioned artwork for commercial or controversial purposes, or if it is unpaid or uncredited. I will not allow clients to claim my artwork as their own, sell it, produce copies of it, nor use it alongside controversial and/or political statements that are intended to cause harm. If a client has any intent to use commissioned artwork from me for commercial purposes, it must be discussed before the commission process begins.
Clients may not repost commissioned artwork on any media-sharing website or social media. Uploading commissioned artwork to display websites such as toyhou.se for character folders is okay, along with sharing it via messaging on Discord or other similar apps and websites, but reposting my artwork on sites such as DeviantArt, Tumblr, Instagram, or anything similar is not permitted. Breaking this rule may lead to being blacklisted from my commissions entirely.
Commissioned artwork may not be traced, edited, or heavily referenced by the client or any other party. Exceptions to this rule may be considered if discussed beforehand, or for commissions that are unfinished and fall under the exceptions listed in section V, rule 1.
III. PAYMENT INFORMATION
The only form of currency that I accept is USD via PayPal. Other methods of payment can be discussed, but must be agreed upon before the commission process begins.
All commissions must be paid in full within 24 hours of receiving an invoice. Exceptions can be made if it is discussed prior to the invoice being sent. In the case that the payment is not received within this time and the client is unresponsive to communication, the commission may be canceled and the unfinished artwork will be reused as YCH.
It is the responsibility of the client to inform me when their payment has been sent. This is to ensure that, in the event of an error on PayPal’s part, the client is not penalized. Screenshots are recommended to be sent along with this confirmation, so that there is verifiable proof of payment, but they are not required. If an error or glitch occurs which prevents payment, I will work with the client until the issue is resolved. There will be no penalty for errors outside of the client’s control.
IV. COMMISSION PROCESS
When the commission process begins, the client will be given an estimated timeframe for completion. If a situation arises to cause a delay, I will notify the client at the soonest possible availability. If, by my own fault, a commission is not completed within 30 days of the commission process beginning, I will provide a full refund.
A work-in-progress (WIP) will be shown to the client at the sketch, lining, and coloring stages. This is the bare minimum, and more WIPs may be provided to ensure a quality product. When a WIP is sent for confirmation, progress on the commission may be paused until a response is received. The client may also request a WIP at any stage in the commission process.
Major revisions can only be made during the sketch stage. This includes changes to posing, body shape, or the addition/removal of limbs such as wings, arms, or legs. The commission will not move past the sketch stage until the client approves of the sketch as a whole.
The commission must be paid in full after the sketch is completed and approved by the client. This is to prevent scamming on both the part of the artist and the client. See section III for more details on payment.
V. CANCELLATIONS & REFUNDS
I, the artist, reserve the right to cancel a commission for any reason. Any commissions canceled without a given reason or due to my own inability to complete it will result in a full refund for the client, who will then have the right to keep whatever progress had been made on the commission to that point.
Please provide a reason for canceling a commission. The reason can be as simple as a lack of funds, poor mental health, or a bad experience with my service. Not only does providing a reason allow me to adjust for the client’s specific circumstance, it also allows me to provide better service for future commissions.
Cancellations may not always result in a full refund. The refund amount may change depending on how much progress has been made on the commission up to the cancellation. For a fully rendered piece, the rough basis for this would be:
Sketch - 100%
Lineart - 60%
Flat Color - 20%
No refunds will be provided for nearly-completed work.
